GENERAL CONDITIONS OF SALE OF THE PRODUCTS SOLD ON THE BEQUIEARTISTE.COM WEBSITE:

ARTICLE 1 - PURPOSE
The present conditions govern the sales by Béquie Artiste of the paintings marketed by the site.
ARTICLE 2 - PRICES
The prices of the paintings are indicated in euros, not including processing and shipping costs.
All orders, whatever their origin, are payable in euros.
Béquie Artiste reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time the order is validated and subject to availability.
The products remain the property of Béquie Artiste until the complete payment of the price.
Attention: as soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.

The contractual information is presented in French, English, Spanish and Chinese, and will be confirmed at the latest at the time of validation of your order.
Only the French version is authentic.
Béquie Artiste reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, or in case of difficulty concerning the order received.
ARTICLE 4 - VALIDATION OF YOUR ORDER
Any order appearing on bequieartiste.com supposes the adhesion to the present General Conditions. Any order confirmation implies your full and entire adhesion to the present general conditions of sale, without exception or reserve.
All the data provided and the recorded confirmation will serve as proof of the transaction.
You claim to have full knowledge of it.
The confirmation of order will be worth signature and acceptance of the operations carried out.
A summary of your order information will be communicated to you via the e-mail address confirming your order.
ARTICLE 5 - PAYMENT
The fact of validating your order implies for you the obligation to pay the price indicated.
The payment of your purchases is made by credit card through the secure system. STRIP.
The card is debited at the time of the order.
ARTICLE 6 - WITHDRAWAL
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.
The return costs are at your charge.
In case of exercising the right of withdrawal, Béquie Artiste will proceed to the reimbursement of the sums paid, within 14 days following the notification of your request. The means of reimbursement will be at the choice of Béquie Artiste (either by bank transfer to your account or by cheque).
ARTICLE 7- AVAILABILITY
My paintings are offered as long as they are visible on bequieartiste.com and within the limits of their availability.
In case of unavailability of product after placing your order, we will inform you by email. Your order will be automatically cancelled and a refund will be made.
ARTICLE 8 - DELIVERY
My paintings are delivered to the delivery address indicated during the ordering process, within 4 to 15 days. The delivery is generally made by post with tracking in a suitable packaging protecting the canvas.
In the event of a delay in shipment, an e-mail will be sent to you to inform you of a possible consequence on the delivery time that has been indicated to you.
In accordance with the legal provisions, in the event of late delivery, you benefit from the possibility of cancelling the order under the terms and conditions defined in article L 138-2 of the Consumer Code. If in the meantime you receive the painting I will proceed to its refund and shipping costs under the conditions of Article L 138-3 of the Consumer Code.
ARTICLE 9 - DISPUTES - CLAIMS
All claims, requests for exchange or refund must be made by email to bequieartiste@gmail.com or by telephone at (33) 6 23 15 16 27.
The paintings must be returned to us in the state in which you received them with all the elements (accessories, packaging, ...). Shipping costs will not be refunded and are therefore at your expense.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
ARTICLE 10 - LIABILITY
Furthermore, Bequie Artiste cannot be held responsible for any damage resulting from misuse of the purchased product.
ARTICLE 11 - APPLICABLE LAW IN THE EVENT OF DISPUTES
The language of this contract is the French language. The present conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction and more particularly that of the town of residence of Marianne Martinez (Béquie Artiste).
ARTICLE 12 - INTELLECTUAL PROPERTY
All the elements of the bequieartiste.com website are and remain the intellectual and exclusive property of the company Béquie Artiste. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of Béquie Artiste.
ARTICLE 13 - PERSONAL DATA
Béquie Artiste reserves the right to collect nominative information and personal data concerning you. They are necessary for the management of your order, as well as to improve the services and information we send you.
They may also be passed on to the companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
The RGPD came into force on 25 May 2018, two years after the adoption of the text, and provides a legal framework for the collection and processing of personal data in the European Union. ARTICLE 14 - ARCHIVING OF EVIDENCE
Béquie Artiste will archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code for 6 years.
Béquie Artiste's computerised registers will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
